Kosovo Wins International Court Of Justice Decision
The international court within the UN, the International Court of Justice, has ruled that Kosovo has the legal right to declare freedom from Serbia. This decision has been hotly argued and long-awaited by both sides of the debate. This decision is going to have effects around the world.
The declaration from Kosovo of freedom from Serbia
Kosovo declared independence from the Serbian state in February of 2008. For various months between 1998 and 1999, separatists from Kosovo were the target of a bloody crackdown by Serbian forces. This crackdown left about 10,000 individuals dead. Response attacks killed an additional several thousand people. Since 1999, a specialty mission of the United Nations has governed the Kosovo region within Serbia. Serbia claims the region of Kosovo is integral to their national identity.
Recognizing the independence of Kosovo
The freedom of Kosovo as a nation has been recognized by only 69 other countries. One hundred nations must recognize a declaration of freedom before the country is allowed to join the United Nations. Serbia requested the International Court of Justice review Kosovo’s freedom declaration.
In a ruling made in late July of 2010, the ICJ agreed that Kosovo did have the right. Specifically, ICJ president Hisashi Owada said that international law “contains no prohibition on declarations of freedom.” There is very little precedence on declarations of freedom within UN Nations, and the court is said to have consulted the breakup of the USSR as an option.
The effect of the ruling
The International Court of Justice ruling that Kosovo’s declaration of freedom is within international law will probably have wide-ranging effects. Numerous separatists around the world are celebrating the ruling. Many nations are declaring that they will fight these declarations of independence. Though the declaration of independence can be under dispute for a very long time, it is possible that this will help Kosovo get the 100 nations necessary for official recognition.
