Scarce Colonial

Was there any form of mediation or arb.in colonial Virginia? Any info. bibliogr. or otherwise appreciated.?
This is for some professional ADR research in legal anthropology. Documentation is rather scarce.
I can only imagine that whatever mediation there was, if any, was done by the clergy and lay clergy. I would check the diaries of clergymen in the colonial era.
